You may have heard about the anti-ICC letter circulating in Congress. It is an "e-Dear Colleague" letter, and the right-wing authors oppose even the participation of the U.S. as an observer in the upcoming Review Conference. UN Dispatch's Mark Leon Goldberg has some background here, but you really ought to read Kevin Jon Heller's response on Opinio Juris, entitled "Dear Colleagues: We'd Like to Share Some Lies with You About the ICC."

ICC Prosecutor Seeks Non-Cooperation Ruling Against Sudan

Prosecutors have asked International Criminal Court judges to involve the UN Security Council in Sudan's refusal to execute arrest warrants for a government official and a militia leader, a court document showed on Thursday. In a request filed earlier in the week, the office of the prosecutor asked judges to issue a "finding of non-cooperation" against the government of Sudan, which would allow the court to "refer the matter to the Security Council".

This week, the judges of the International Criminal Court authorized the court's Prosecutor to open a formal investigation of Kenya’s post-election violence, raising the prospect that political leaders from the East African nation might face trial at the court.
